Withdrawal notice

1. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period:

a.) expires 14 days after the day on which you or a third party designated by you, other than the carrier, takes delivery of the goods;
b) in the case of multiple deliveries, expires 14 days after the day on which you or a third party designated by you, other than the carrier, takes delivery of the last item.;
c) when goods consisting of multiple items or pieces are delivered: upon receipt of the last item or piece by you or by a third party designated by you who is not the carrier;

For this purpose, you may also use the attached sample withdrawal form.

You may also exercise your right of withdrawal online at the following address: click on the button. If you use this online feature, we will immediately confirm receipt of your withdrawal—including the content, date, and time of the withdrawal—via a durable medium (such as email).

You can also fill out the sample withdrawal notice on our website at www.boardgamesmasters.com under the “Withdrawal from the Contract” subpage, or submit another statement that clearly expresses your intention to withdraw. If you choose to do so, we will immediately confirm receipt of your withdrawal on a durable medium (such as via email).

You will have exercised your right of withdrawal in a timely manner if you send your notice of withdrawal before the expiration of the deadline specified above.

2. Legal Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments you have made, including the shipping cost, without delay, but no later than 14 days from the date we receive your notice of withdrawal (except for any additional costs incurred because you chose a shipping method other than the cheapest standard shipping method we offer.) We will issue the refund using the same payment method used for the original transaction, unless you expressly consent to the use of a different payment method; you will not incur any additional costs as a result of this refund method. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned them, whichever occurs first.

You are required to return or hand over the goods to us without undue delay, but no later than 14 days from the date you notified us of your cancellation. The deadline is considered met if you ship the goods before the 14-day period expires.

You are responsible for the direct cost of returning the goods.

You may be held liable for any loss in value of the goods only if such loss resulted from use that exceeded what is necessary to determine the nature, characteristics, and functioning of the goods.

INFORMATION ON THE WARRANTY OF FITNESS FOR PURPOSE, THE PRODUCT WARRANTY, AND THE WARRANTY OF QUALITY

1. Warranty of Fitness for Purpose

In what circumstances can you exercise your right under the warranty of fitness for purpose?

What rights do you have under the warranty for defects?

You may, at your discretion, exercise the following warranty claims:

You may request repair or replacement, unless the claim you have chosen is impossible to fulfill or would entail disproportionate additional costs for the business compared to fulfilling another claim.

If you did not request or were unable to request a repair or replacement, you may request a proportional reduction in the price, or you may repair the defect yourself or have it repaired by someone else at the business’s expense, or—as a last resort—you may withdraw from the contract.

In the case of a contract between a consumer and a business—whether for the sale of goods classified as movable property, the provision of digital content, or the provision of digital services—you may not, as part of exercising your rights under the warranty of quality, repair the defect yourself at the business’s expense, nor may you have it repaired by a third party.

You may switch from one warranty option to another, but you are responsible for the cost of the switch, unless it was justified or the business gave you cause to do so.

What is the deadline for filing a warranty claim?

You are required to report the defect immediately upon discovery, but no later than two months after the defect is discovered. However, please note that you can no longer assert your warranty rights after the two-year statute of limitations from the date of performance of the contract has expired.

Against whom can you assert your warranty claim?

You may assert your warranty claim against the business.

What other conditions apply to asserting your warranty rights?

2. Product Warranty

In what circumstances can you exercise your right under the product warranty?

In the event of a defect in a movable item (hereinafter referred to as “product” for the purposes of this section), you may—at your discretion—exercise the right specified in Section 1 or assert a claim under the product warranty in accordance with the provisions of the Civil Code.

What rights do you have under a product warranty claim?

As part of a product warranty claim, you may request that the defective product be repaired or replaced.

Against whom can you assert your product warranty claim?

You may exercise your product warranty rights against the product’s manufacturer or distributor (hereinafter collectively referred to as “the manufacturer”).

Under what circumstances is a product considered defective?

A product is defective if it does not meet the quality requirements in effect at the time it was placed on the market, or if it does not possess the characteristics specified in the manufacturer’s description.

What is the time limit for asserting a product warranty claim?

You may assert a product warranty claim within two years from the date the product was placed on the market by the manufacturer. Once this period has expired, you lose this right.

What is the burden of proof when asserting a product warranty claim?

When asserting a product warranty claim, you must prove that the product defect existed at the time the manufacturer placed the product on the market.

Under what circumstances is a manufacturer exempt from its product warranty obligations?

A manufacturer is exempt from its product warranty obligations if it can prove that

– the product was not manufactured or placed on the market in the course of its business activities, or

– the defect was not recognizable at the time the product was placed on the market, given the state of science and technology at that time, or

– the defect in the product results from the application of a law or a mandatory regulatory requirement. The manufacturer need only prove one of these grounds to be exempt.

Please note that you may assert a claim under the seller’s warranty against the business and a claim under the manufacturer’s warranty against the manufacturer simultaneously and in parallel for the same defect. If your product warranty claim is successfully enforced, you may thereafter assert your warranty claim regarding the replaced product or the repaired part of the product only against the manufacturer.

3. Warranty

In what circumstances can you exercise your warranty rights?

In the event of defective performance, you may assert a warranty claim in accordance with the provisions of the Civil Code, based on applicable law and/or a legal declaration establishing the warranty (please underline as appropriate).

What rights do you have if the warranty is based on law?

In the case of a new durable consumer good (hereinafter referred to as “consumer good”) as defined in the ministerial decree on the designation of product groups of durable consumer goods subject to mandatory warranty, you may exercise the rights specified in paragraph 1 due to a defect in performance, subject to the conditions set forth in the government decree on mandatory warranties for specific durable consumer goods.

Within what time frame can you exercise your rights under the mandatory warranty?

The duration of the warranty for consumer goods is

a) two years for sales prices ranging from HUF 10,000 to HUF 250,000,

b) three years for a sales price exceeding HUF 250,000 forints (starting at HUF 250,001).

Under what conditions can warranty claims be enforced:

You may exercise your rights under the warranty using the warranty certificate provided to you; any irregularity in the issuance of the warranty certificate or failure to provide it does not affect the validity of the warranty. If the warranty certificate is not provided, the contract shall be deemed to have been concluded if you present a receipt proving payment of the purchase price. The fulfillment of a warranty claim is not contingent upon the consumer product’s packaging having been opened.

What additional requirements may be imposed as conditions for exercising warranty rights?

Special requirements (such as periodic inspections) may be imposed on the consumer to ensure the proper installation or maintenance of a consumer product, provided that proper installation or maintenance cannot be ensured by other means and that compliance with the requirement does not impose a disproportionate burden on the consumer.

When is a business exempt from its warranty obligation?

The business is exempt from its warranty obligation if it proves that the defect arose after performance.

Please note that you may assert claims under the warranty for defects and the warranty for performance, as well as claims under the product warranty and the warranty for performance, simultaneously and in parallel for the same defect. However, if you have successfully asserted a claim arising from defective performance due to a specific defect (for example, the business replaced the product), with respect to that same defect.
